Summary

This summary is here to help you read the rest. It does not replace the full Terms below.

  • Eyes on the road. Set up your trip before you drive. Only passengers, or you when safely parked, should use the screen. Road signs, traffic laws and the police always come before the App.
  • Check before you go. Place details, hours and drive times can be wrong. Never enter private property, and travel at your own risk.
  • You must be 18 or older. Kids are welcome along for the ride with a parent or guardian.
  • The podcasts belong to their creators. StoryMiles points you to them; it does not own or host them. Creators can ask us to change or remove anything.
  • Your journal is yours and stays private. Place suggestions you send us may be published in the App.
  • StoryMiles Plus is billed by Apple. The yearly plan renews automatically until you cancel in your Apple ID settings. Refunds are handled by Apple.
  • Disputes go to individual arbitration, not court or class actions, unless you opt out within 30 days (section 18).

PLEASE READ SECTION 18 CAREFULLY. IT REQUIRES YOU AND US TO RESOLVE MOST DISPUTES BY BINDING INDIVIDUAL ARBITRATION, AND WAIVES THE RIGHT TO A JURY TRIAL AND TO TAKE PART IN A CLASS ACTION, UNLESS YOU OPT OUT. THE STORYMILES PLUS YEARLY SUBSCRIPTION RENEWS AUTOMATICALLY UNTIL YOU CANCEL (SECTION 7).

1. Agreement to Terms

By downloading, accessing or using StoryMiles (the “App” or “Service”), you agree to these Terms of Service (“Terms”). If you do not agree, do not use the App.

StoryMiles is operated by Son of a Good Man LLC, a California limited liability company (“Company,” “we,” “our,” or “us”). Your use of StoryMiles is also governed by the StoryMiles Privacy Policy, which explains what information the App handles and where it goes.

1.1 Eligibility

You must be at least 18 years old, or the age of majority where you live if that is higher, to use StoryMiles, create an account or buy StoryMiles Plus. StoryMiles plans road trips, and road trips need a licensed driver. Younger travelers are welcome along for the ride with a parent or guardian, who uses the App on their behalf and is responsible for that use. You may not use StoryMiles if you are barred from doing so under the laws of the United States or the country where you live.

2. Using StoryMiles

StoryMiles helps you find real places connected to podcasts and audio stories, plan a road trip around them, hear stops announced as you drive, and keep a private journal of the trip.

We grant you a personal, non-exclusive, non-transferable, revocable license to use the App on devices you own or control, for your own non-commercial use, subject to these Terms.

2.1 Accounts

You do not need an account to browse, plan, listen or keep a journal. If you sign in with Apple or Google, your data syncs to a private account. You are responsible for activity under your account and for keeping your Apple or Google sign-in secure. Tell us promptly at support@sonofagoodman.com if you believe someone else has accessed it.

3. Safety on the Road

Your safety, and the safety of everyone around you, comes before anything in this App.

  • Do not interact with the App while driving. Set up your trip, choose your story and start playback before you set off. StoryMiles is designed so that announcements and audio play without you touching the phone.
  • Journal, check in, take photos and browse only as a passenger, or when you are safely parked. A passenger using the App should not distract the driver.
  • Obey all traffic laws, road signs and the directions of law enforcement, and drive for the actual road, weather and traffic conditions. If anything in the App conflicts with a sign, a signal, the road in front of you or an officer, follow them, not the App. Never rely on the App instead of your own judgment.
  • Directions, distances and drive times are estimates. Routes may be closed, unsafe, seasonal or unsuitable for your vehicle. Use your judgment and an up-to-date navigation app.
  • Announcements can be late, early or missing, for example when your phone has no signal, its location is inaccurate, or location access is turned off. Do not make sudden manoeuvres because of an announcement.
  • StoryMiles is not an emergency service. Do not rely on it to find help or to contact emergency services.
  • Follow the laws where you are about using a phone in a vehicle.

4. Travel and Outdoor Places: Assumption of Risk

Road trips, and visiting the places in StoryMiles, carry real risks. These include traffic, long drives and fatigue, remote areas without signal, fuel, services or help nearby, rough or unpaved roads, wildlife, terrain, water, heat, cold and other weather, the condition of old or abandoned sites, and the conduct of other people. Some places in StoryMiles are outdoors, remote or connected to dangerous events.

You choose where to go and what to do, and you take part in travel and outdoor activities voluntarily and at your own risk. You are responsible for your own safety, preparation, vehicle, equipment and judgment, and for the safety of those travelling with you, including children. To the fullest extent permitted by law, you assume the risks of travel and of visiting places you learn about through StoryMiles. Nothing in this section limits liability that cannot be limited by law, including for our gross negligence or wilful misconduct.

5. Places and Information

  • Check before you go. Information about places, including opening hours, prices, accessibility, ratings and whether a place is open to the public at all, can be incomplete or out of date. Some of it comes from Google and other third parties. Confirm with the place directly before you travel.
  • Respect private property and closures. Never enter private property without permission, and obey posted closures, hours, permits and restrictions. A place appearing in StoryMiles does not mean you have a right to enter it.
  • Be respectful. Some stories involve real events that affected real people and communities. Please visit thoughtfully. We aim not to list private homes or places where someone was harmed; if you find one, tell us and we will review it.

6. Podcasts, Third-Party Content and Copyright

6.1 Owned by Their Creators

The podcasts and audio stories featured in StoryMiles, including their audio, titles, artwork and descriptions, belong to their creators and publishers. StoryMiles does not host them. Episodes stream from each publisher’s public podcast feed, or open in another app such as Spotify, Apple Podcasts or Audible. Nothing in these Terms gives you any right to podcast content beyond listening to it as its publisher makes it available.

StoryMiles is not affiliated with, sponsored by or endorsed by the podcasts it features, unless we clearly say so. Featuring a show is not a claim that its creators endorse StoryMiles, or that we endorse everything in the show.

Shows may change, move or remove episodes at any time, so a story may stop being available in StoryMiles. The views in a podcast are those of its creators, and we are not responsible for podcast content, including its accuracy and any ads in it.

6.2 Content Notes

Some stories cover true crime, violence and other mature subjects. We label these in the App so you can decide what to listen to, especially with children in the car. Labels are our best effort and may not cover everything that a listener might find upsetting.

6.3 For Podcast Creators

If you make a show featured in StoryMiles and want it removed, corrected, or presented differently, email support@sonofagoodman.com with the name of your show, the episodes or places concerned, and what you would like changed. We will respond promptly, and we will remove a show at its owner’s request. You do not need to send a formal copyright notice for this. Creators can also suggest places for their own show from inside the App.

6.4 Copyright Complaints

We respect intellectual property rights and respond to notices of alleged copyright infringement under the Digital Millennium Copyright Act (“DMCA”). If you believe something in StoryMiles infringes your copyright, send a notice to our designated copyright agent, registered with the U.S. Copyright Office:

Copyright Agent, Son of a Good Man LLC
435 E. Market St., Long Beach, CA 90805, United States
Email: support@sonofagoodman.com (subject line: “Copyright Notice”)

Your notice must include:

  • Your physical or electronic signature, as the copyright owner or a person authorized to act for the owner
  • A description of the copyrighted work you say is infringed
  • A description of the material you say is infringing, and where it is in StoryMiles, in enough detail for us to find it (for example, the story, place or screen)
  • Your name, postal address, telephone number and email address
  • A statement that you believe in good faith that the use is not authorized by the copyright owner, its agent or the law
  • A statement that the information in your notice is accurate and, under penalty of perjury, that you are the owner or are authorized to act for the owner

We may remove or disable access to material that is the subject of a valid notice, and we may share your notice with the person who provided the material. Knowingly misrepresenting that material is infringing can make you liable for damages under the DMCA.

6.5 Counter-Notices

If material you provided (such as a place suggestion) was removed and you believe that was a mistake, you can send a counter-notice to the same address. It must include your physical or electronic signature; a description of the material that was removed and where it appeared; a statement under penalty of perjury that you believe in good faith it was removed by mistake or misidentification; and your name, address and telephone number, with a statement that you consent to the jurisdiction of the federal court for your district (or, if you are outside the United States, for the Central District of California) and will accept service of process from the person who sent the original notice. We may restore the material in 10 to 14 business days unless the original complainant tells us it has filed a court action.

6.6 Repeat Infringers

We will, in appropriate circumstances, end the accounts of people who repeatedly infringe others’ rights.

7. StoryMiles Plus

7.1 What’s Free and What’s Plus

Discovering stories, listening, stop announcements and your journal are free. StoryMiles Plus adds features that cost us money to run: more than one planned trip at a time, multi-day trips, real drive times, downloads for listening without signal, and backup of your journal photos. Drive times and photo backup also need a free account. We may change what is included in Plus from time to time.

7.2 Plans and Prices

  • StoryMiles Plus (yearly): $29.99 per year, an auto-renewing subscription
  • Trip Pass: $5.99 for 7 days of Plus. It does not renew.

Prices are in U.S. dollars. Prices in other countries, and any taxes, are shown in the App Store before you buy.

7.3 Billing, Automatic Renewal and Cancellation

  • Purchases are made through Apple, and payment is charged to your Apple ID when you confirm the purchase. Apple’s terms for purchases also apply.
  • The yearly subscription renews automatically each year at the then-current price unless you cancel at least 24 hours before the end of the current period. Your Apple ID is charged for the renewal within the 24 hours before the period ends.
  • You can manage or cancel your subscription at any time in your Apple ID settings (on iPhone, Settings → your name → Subscriptions), or from Profile in the App. If you cancel, Plus stays active until the end of the period you have paid for.
  • Deleting the App or your StoryMiles account does not cancel your subscription.
  • If we change the price of the subscription, Apple will notify you in advance as its rules require, and you can cancel before the new price applies.

7.4 Free Trials and Offers

If we offer a free trial or an introductory price, the App Store will show its length and what you will be charged afterwards. Unless you cancel at least 24 hours before the trial or offer ends, your subscription will continue at the regular price.

7.5 Refunds

Because purchases are processed by Apple, we cannot issue refunds directly. You can request a refund from Apple at reportaproblem.apple.com, and Apple decides refund requests under its own policies.

8. Your Content

8.1 Your Journal Is Private

Your trips, journal entries and photos are yours. They are private, and they are not shown to other users. If you are signed in, you allow us to store, sync and back them up only so that we can provide the Service to you. We do not publish them or use them for any other purpose. Please keep your own copies of anything important; we are not responsible for content lost from your device.

8.2 Place Suggestions

You keep any rights you have in what you submit. When you suggest a place, you grant us a worldwide, non-exclusive, royalty-free, perpetual and irrevocable license to use, edit, adapt and publish your suggestion as part of the StoryMiles catalogue. If you tell us you make the show, we may credit your show. You agree that your suggestion is accurate to the best of your knowledge, is a place the public can visit, is not a private home or a place where someone was harmed, and that you have the right to send it to us. We review every suggestion and may decline or remove any of them.

8.3 Shared Trip Links

You can share a trip plan by sending a link. Links are sent only when you choose, to the people you choose. The plan travels inside the link, so anyone who has it can see what it contains, including your starting point. You are responsible for who you share it with.

8.4 Feedback

If you send us ideas or feedback about StoryMiles, we may use them without any obligation to you.

9. Acceptable Use

You agree not to:

  • Use the App in a way that endangers yourself or others, including while driving
  • Use StoryMiles to trespass, harass anyone, or disturb residents, victims or their families
  • Submit suggestions that are false, abusive, infringing, or that point to private homes
  • Copy, scrape or redistribute the StoryMiles catalogue or podcast content, or use it to train or prompt an AI model
  • Reverse engineer, interfere with, or overload the App or our servers, or misuse the place and route search
  • Get around StoryMiles Plus or any other limits
  • Use StoryMiles for any commercial purpose without our written permission
  • Break any law

10. Our Intellectual Property

StoryMiles, including its software, design, branding and the catalogue we curate and write, is owned by Son of a Good Man LLC and protected by intellectual property laws. StoryMiles™ is a trademark of Son of a Good Man LLC. You may not copy, modify, distribute or create derivative works from it without our permission. Map data and place information belong to their providers. All rights not expressly granted in these Terms are reserved.

11. Third-Party Services

StoryMiles relies on Apple (App Store, Sign in with Apple, Apple Maps), Google (Google Maps, Places, Routes and Google Sign-In), Supabase (accounts and storage), RevenueCat (purchase status), and the hosts of each podcast. Where StoryMiles shows Google Maps, you also agree to the Google Maps/Google Earth Additional Terms of Service, and the Google Privacy Policy applies. See the StoryMiles Privacy Policy for what each service receives.

We are not responsible for third-party services, their content, their availability or their policies. You are responsible for any data charges from your mobile carrier.

12. Apple App Store Terms

If you downloaded StoryMiles from the Apple App Store:

  • Apple’s Licensed Application End User License Agreement (the standard EULA) also applies. These Terms add to it. Where they conflict, the standard EULA governs to the extent Apple requires.
  • These Terms are between you and Son of a Good Man LLC, not Apple. We, not Apple, are solely responsible for the App and its content.
  • Your license to use the App is limited to Apple-branded devices that you own or control, as permitted by the Usage Rules in the App Store Terms of Service.
  • Apple has no obligation to provide maintenance or support for the App.
  • If the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any. To the maximum extent permitted by law, Apple has no other warranty obligation for the App, and any other claims, losses, liabilities, damages, costs or expenses from a failure to conform to a warranty are our responsibility, to the extent these Terms do not disclaim them.
  • Apple is not responsible for addressing any claims by you or a third party relating to the App or your use of it, including product liability claims, claims that the App fails to meet legal or regulatory requirements, and claims under consumer protection, privacy or similar laws.
  • If a third party claims that the App or your use of it infringes their intellectual property rights, we, not Apple, are responsible for investigating, defending, settling and discharging that claim, to the extent these Terms require.
  • You confirm that you are not located in a country subject to a U.S. Government embargo or designated as “terrorist supporting,” and that you are not on any U.S. Government list of prohibited or restricted parties.
  • You must comply with any third-party terms that apply when you use the App, such as your wireless data service agreement.
  • Questions, complaints or claims about the App should be sent to us at the address in section 22.
  • Apple and its subsidiaries are third-party beneficiaries of these Terms. Once you accept these Terms, Apple has the right (and will be deemed to have accepted the right) to enforce them against you as a third-party beneficiary.

13. Changes to the App

We are always working on StoryMiles, so we may add, change or remove features, stories and places, and we may stop offering the App. If we stop offering StoryMiles Plus, we will tell you in advance where we can, and paid subscriptions will not renew.

14. Termination

You can stop using StoryMiles and delete your account at any time in the App (Profile) or at sonofagoodman.com/request-account-deletion. We may suspend or end your access if you seriously or repeatedly break these Terms, if you put others at risk, or if the law requires it. Where it is reasonable, we will tell you why. Sections 4, 6, 8.2, 8.4, 10 and 15 to 21 survive termination.

15. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.”

TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT AND ACCURACY. We do not guarantee that directions, drive times, place information, announcements or podcast content are accurate, complete, current, safe or available, or that the App will work without interruption or errors, including where there is no signal. Some jurisdictions do not allow these disclaimers, so some of them may not apply to you.

16. Limitation of Liability

To the maximum extent permitted by law:

  • Son of a Good Man LLC and its members, employees and agents are not liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for loss of data, profits or goodwill, arising from your use of StoryMiles or your travel, even if we were told they were possible.
  • Our total liability for all claims relating to StoryMiles will not exceed the greater of the amount you paid for StoryMiles Plus in the 12 months before the claim, or $100.

Some jurisdictions do not allow these exclusions or limits, so some of them may not apply to you. Nothing in these Terms limits liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot be limited by law.

17. Indemnification

You agree to indemnify and hold harmless Son of a Good Man LLC and its members, employees and agents from claims, losses and reasonable legal fees arising out of your use of the Service in violation of these Terms or the law, your place suggestions, or your violation of anyone else’s rights, including by entering property without permission or using the App while driving. We may take control of the defence of any such claim, and you agree to cooperate with us.

18. Dispute Resolution and Arbitration

18.1 Talk to Us First

Most concerns can be solved quickly. Before bringing a claim, email support@sonofagoodman.com with your name, your contact details, a description of the problem and what you would like us to do. We will try to resolve it informally. If we cannot within 60 days, either of us may start arbitration or, where this section allows, go to court.

18.2 Binding Individual Arbitration

Except as described in section 18.3, you and we agree that any dispute or claim relating to StoryMiles or these Terms will be resolved by binding individual arbitration administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules, available at adr.org. The Federal Arbitration Act governs this section. The arbitrator decides all questions about the dispute, including whether a claim must be arbitrated, except that a court decides questions about the class-action waiver in section 18.4. Fees are paid as the AAA Consumer Arbitration Rules provide, and we will not seek our legal fees from you unless the arbitrator finds your claim frivolous. Hearings will take place by video or telephone where possible, or otherwise in the county where you live or another place we both agree. The arbitrator can award the same individual relief a court could, and their decision is final, except for the limited review the law allows.

YOU AND WE ARE EACH GIVING UP THE RIGHT TO SUE IN COURT AND TO HAVE A JURY TRIAL.

18.3 Exceptions

Either of us may instead:

  • Bring an individual claim in small claims court, as long as it stays there
  • Ask a court to stop the infringement or misuse of intellectual property
  • Seek public injunctive relief in court where the law does not allow it to be waived; any such claim will be put on hold until the arbitration of individual claims is complete

18.4 Class-Action Waiver

You and we may bring claims against each other only individually, and not as a plaintiff or class member in any class, collective or representative proceeding. The arbitrator may not combine more than one person’s claims or preside over any class or representative proceeding. If a court decides that this waiver cannot be enforced for a particular claim, that claim will be decided in court and not in arbitration.

18.5 Opting Out

You can opt out of this agreement to arbitrate within 30 days of first accepting these Terms by emailing support@sonofagoodman.com with the subject line “Arbitration Opt-Out,” your name, and the email address on your StoryMiles account if you have one, saying that you want to opt out. Opting out does not affect any other part of these Terms, and it will not affect your use of StoryMiles.

18.6 Courts

Any dispute that is not arbitrated, including if you opt out, will be decided exclusively in the state or federal courts located in Los Angeles County, California, and you and we consent to their jurisdiction and venue.

18.7 Changes to This Section

If we change this section, the change will not apply to any dispute you have already told us about. You may reject a material change by emailing us within 30 days of it taking effect, in which case the previous version of this section continues to apply to you.

18.8 Outside the United States

If you are a consumer in a country that gives you the right to bring claims in your local courts or under your local law, nothing in this section takes that right away.

19. Governing Law

These Terms are governed by the laws of the State of California and applicable U.S. federal law, without regard to conflict of law rules. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

20. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the Last Updated date. If a change is material, we will tell you in the App before it takes effect. Continued use of StoryMiles after a change takes effect means you accept the updated Terms. If you do not agree, stop using StoryMiles and cancel any subscription.

21. General

  • Entire agreement. These Terms, together with the Privacy Policy and, where it applies, Apple’s standard EULA, are the entire agreement between you and us about StoryMiles.
  • Severability. If any part of these Terms is found unenforceable, it will be enforced to the maximum extent possible and the rest remains in effect.
  • No waiver. Our not enforcing a provision is not a waiver of it.
  • Assignment. You may not transfer these Terms; we may transfer them as part of a merger, acquisition or sale of assets.
  • Force majeure. We are not responsible for delays or failures caused by events beyond our reasonable control.
  • Export. You agree to comply with U.S. export and sanctions laws in using the App.
  • Notices. We may send you notices in the App or by email to the address on your account. You can send notices to us at the address in section 22.
  • California users. Under California Civil Code § 1789.3, California users may contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs in writing at 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or by telephone at (800) 952-5210.
